ในการพิจารณาจ่ายค่าทดแทนและค่าใช้จ่ายแก่จำเลยในคดีอาญา ให้คณะกรรมการคำนึงถึงพฤติการณ์ของคดี ความเดือนร้อนที่ได้รับ และโอกาสที่จำเลยจะได้รับการชดเชยความเสียหายจากทางอื่นด้วย
