ให้มีคณะกรรมการสวัสดิการแรงงานประกอบด้วย ปลัดกระทรวงแรงงาน*เป็นประธานกรรมการ กรรมการผู้แทนฝ่ายรัฐบาลสี่คน กรรมการผู้แทนฝ่ายนายจ้างและกรรมการผู้แทนฝ่ายลูกจ้างฝ่ายละห้าคน ซึ่งรัฐมนตรีแต่งตั้งเป็นกรรมการ และข้าราชการกรมสวัสดิการและคุ้มครองแรงงานซึ่งรัฐมนตรีแต่งตั้งเป็นเลขานุการ
