หมวด ๖ บทกำหนดโทษ

ผู้ใดโดยเหตุที่ตนมีตำแหน่งหน้าที่ในการดูแลรักษาความลับทางการค้าตามระเบียบที่ออกตามความในมาตรา ๑๕ วรรคหนึ่ง เปิดเผยหรือใช้ความลับนั้นเพื่อประโยชน์ของตนเองหรือผู้อื่นโดยมิชอบ ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสองแสนบาท หรือทั้งจำทั้งปรับ
