พระราชบัญญัตินี้ไม่ใช้บังคับแก่
(๑) สถานศึกษาที่มีนักเรียนรวมกันไม่เกินเจ็ดคน
(๒) สถานศึกษาที่คณะสงฆ์จัดตั้งขึ้นโดยมีวัตถุประสงค์เพื่อให้การศึกษาอบรม และสั่งสอนพระธรรมวินัย
(๓) สถานศึกษาอื่นที่กำหนดในกฎกระทรวงตามข้อเสนอของคณะกรรมการ
