กองทรัสต์เป็นทรัพย์สินที่มิอาจนำมาชำระหนี้ส่วนตัวของทรัสตีได้ ในกรณีที่ทรัสตีล้มละลายเนื่องจากหนี้ส่วนตัว หรือเมื่อความเป็นนิติบุคคลของทรัสตีสิ้นสุดลง มิให้นำกองทรัสต์มารวมเป็นทรัพย์สินในคดีล้มละลายหรือในการชำระบัญชี แล้วแต่กรณี
