ในคดีความผิดเกี่ยวกับยาเสพติดซึ่งศาลมีคำพิพากษาถึงที่สุดให้ประหารชีวิตหรือจำคุกตลอดชีวิตผู้ใด และผู้นั้นยังมิได้รับโทษหรือได้รับโทษแต่ยังไม่ครบถ้วนเพราะหลบหนี ถ้ายังมิได้ตัวผู้นั้นมาเพื่อรับโทษเกินกำหนดเวลาสามสิบปีนับแต่วันที่มีคำพิพากษาถึงที่สุดหรือนับแต่วันที่ผู้นั้นหลบหนี แล้วแต่กรณี เป็นอันล่วงเลยการลงโทษ จะลงโทษผู้นั้นมิได้
