ในกรณีที่กฎกระทรวง ระเบียบ หรือข้อบังคับตามพระราชบัญญัตินี้ยังไม่ได้ประกาศใช้ หรือยังไม่มีผลใช้บังคับ หากมีความจำเป็นต้องดำเนินการใดเกี่ยวกับการส่งผู้ร้ายข้ามแดนให้ดำเนินการได้ตามวิธีการและบทบัญญัติตามพระราชบัญญัติส่งผู้ร้ายข้ามแดน พุทธศักราช ๒๔๗๒ และสนธิสัญญาส่งผู้ร้ายข้ามแดนระหว่างประเทศไทยกับประเทศผู้ร้องขอ
