หมวด ๑๑ ความรับผิดทางแพ่ง

ผู้ผลิต ผู้นำเข้า หรือผู้ขายเครื่องมือแพทย์ ต้องรับผิดชอบในความเสียหายที่เกิดจากการใช้เครื่องมือแพทย์ เว้นแต่จะพิสูจน์ได้ว่าความเสียหายเกิดแต่เหตุสุดวิสัย หรือมิได้เกิดจากความบกพร่องของเครื่องมือแพทย์นั้น หรือเกิดเพราะความผิดของผู้เสียหายนั้นเอง
