(๑) ผู้ประกอบการตรวจสอบและรับรองซึ่งเป็นหน่วยงานของรัฐ
(๒) การมาตรฐานในเรื่องหนึ่งเรื่องใดที่มีกฎหมายบัญญัติไว้โดยเฉพาะแล้ว หน่วยงานของรัฐตาม (๑) ที่ประสงค์จะใช้หรือแสดงเครื่องหมายตามมาตรา ๔๕ ให้กระทำได้เมื่อได้รับอนุญาตจากผู้อนุญาตตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่คณะกรรมการกำหนด
