เมื่อปรากฏต่อพนักงานเจ้าหน้าที่ว่านิติกรรมที่คู่กรณีนำมาขอจดทะเบียนนั้นเป็นโมฆะกรรม พนักงานเจ้าหน้าที่ไม่ต้องจดทะเบียนให้ หากนิติกรรมที่คู่กรณีนำมาขอจดทะเบียนนั้นปรากฏว่าเป็นโมฆียะกรรม ให้พนักงานเจ้าหน้าที่รับจดทะเบียนในเมื่อคู่กรณีฝ่ายที่อาจเสียหายยืนยันให้จด
