ให้สำนักงานมีเลขาธิการคนหนึ่ง ซึ่งประธานผู้ตรวจการแผ่นดินแต่งตั้งขึ้นโดยความเห็นชอบร่วมกันของผู้ตรวจการแผ่นดิน เป็นผู้บังคับบัญชาพนักงานและลูกจ้างของสำนักงานและรับผิดชอบการปฏิบัติงานของสำนักงาน ขึ้นตรงต่อประธานผู้ตรวจการแผ่นดิน
