บุคคลที่จะเป็นพยานตามพระราชบัญญัตินี้ไม่ได้ คือ
(๑) บุคคลซึ่งยังไม่บรรลุนิติภาวะ
(๒) บุคคลวิกลจริตหรือบุคคลซึ่งศาลสั่งให้เป็นผู้เสมือนไร้ความสามารถ
(๓) บุคคลที่หูหนวก เป็นใบ้ หรือจักษุบอดทั้งสองข้าง
