ในวาระเริ่มแรก ให้คณะกรรมการความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงานตามพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. ๒๕๔๑ ซึ่งดำรงตำแหน่งอยู่ในวันที่พระราชบัญญัตินี้ใช้บังคับ ปฏิบัติหน้าที่คณะกรรมการตามพระราชบัญญัตินี้ไปจนกว่าจะมีการแต่งตั้งคณะกรรมการตามพระราชบัญญัตินี้ ซึ่งต้องไม่เกินหนึ่งร้อยแปดสิบวันนับแต่วันที่พระราชบัญญัตินี้ใช้บังคับ
