หมวด ๒ แดนแห่งกรรมสิทธิ์ และการใช้กรรมสิทธิ์

เมื่อรั้วต้นไม้ หรือคูซึ่งมิได้ใช้เป็นทางระบายน้ำ เป็นของเจ้าของที่ดินทั้งสองข้างรวมกัน ท่านว่าเจ้าของข้างใดข้างหนึ่งมีสิทธิที่จะตัดรั้วต้นไม้ หรือถมคูนั้นได้ถึงแนวเขตที่ดินของตน แต่ต้องก่อกำแพง หรือทำรั้วตามแนวเขตนั้น
