ถ้าเหตุอันทำให้คู่หมั้นบอกเลิกสัญญาหมั้นเป็นเพราะการกระทำชั่วอย่างร้ายแรงของคู่หมั้นอีกฝ่ายหนึ่งซึ่งได้กระทำภายหลังการหมั้น คู่หมั้นผู้กระทำชั่วอย่างร้ายแรงนั้นต้องรับผิดใช้ค่าทดแทนแก่คู่หมั้นผู้ใช้สิทธิบอกเลิกสัญญาหมั้นเสมือนเป็นผู้ผิดสัญญาหมั้น
