คำสั่งกระทรวงที่มิได้อาศัยอำนาจตามบทกฎหมายนั้น ย่อมเป็นเพียงระเบียบภายในระหว่างเจ้าหน้าที่ของกระทรวงด้วยกันเท่านั้น จะใช้บังคับแก่บุคคลทั่วไปไม่ได้ ฉะนั้น เมื่อจำเลยมีหน้าที่ตามกฎหมาย ให้รับจดทะเบียนสมรส ก็ย่อมจะอ้างคำสั่งที่ขัดต่อกฎหมายมาเป็นเหตุไม่ยอมปฏิบัติหน้าที่ตามกฎหมายหาได้ไม่
