ในระหว่างผู้สืบสันดานต่างชั้นกันนั้น บุตรของเจ้ามรดกอันอยู่ในชั้นสนิทที่สุดเท่านั้นมีสิทธิรับมรดก ผู้สืบสันดานที่อยู่ในชั้นถัดลงไปจะรับมรดกได้ก็แต่โดยอาศัยสิทธิในการรับมรดกแทนที่
