หมวด ๓ ผลและการตีความแห่งพินัยกรรม

ถ้าทรัพย์สินซึ่งเป็นวัตถุแห่งพินัยกรรมนั้น ได้สูญหาย ทำลาย หรือบุบสลายไป และพฤติการณ์ ทั้งนี้ เป็นผลให้ได้ทรัพย์สินอื่นมาแทน หรือได้สิทธิเรียกร้องเอาค่าสินไหมทดแทนทรัพย์สินนั้น ผู้รับพินัยกรรมจะเรียกให้ส่งมอบของแทนซึ่งได้รับมานั้น หรือจะเรียกร้องเอาค่าสินไหมทดแทนเสียเองก็ได้ แล้วแต่กรณี
