ในกรณีที่ยังมิได้มีการจัดตั้งสถานคุ้มครองคนไร้ที่พึ่งตามพระราชบัญญัตินี้ให้สถานสงเคราะห์ในสังกัดกระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ที่ทำหน้าที่ให้การคุ้มครองคนไร้ที่พึ่งอยู่ในวันที่พระราชบัญญัตินี้ใช้บังคับ เป็นสถานคุ้มครองคนไร้ที่พึ่งชั่วคราวเพื่อดำเนินการตามพระราชบัญญัตินี้
