หมวด ๕ การฟ้องเรียกค่าเสียหาย

สิทธิในการฟ้องเรียกค่าเสียหายจากการรับขนทางอากาศเป็นอันระงับสิ้นไปถ้าไม่มีการฟ้องคดีภายในระยะเวลาสองปีนับแต่วันที่อากาศยานถึงถิ่นปลายทาง หรือนับแต่วันที่อากาศยานนั้นควรจะได้ถึงแล้ว หรือนับแต่วันที่การรับขนได้หยุดลง แล้วแต่กรณี วิธีการคำนวณระยะเวลาตามวรรคหนึ่ง ให้เป็นไปตามกฎหมายแห่งประเทศซึ่งศาลที่พิจารณาพิพากษาคดีตั้งอยู่
