หมวดที่ ๕ ว่าด้วยลักษณะปกครองอำเภอ

พนักงานปกครองกิ่งอำเภอ จะมีกรมการอำเภอรองแต่นายอำเภอตำแหน่งใดอยู่ประจำการ และจะมีเสมียนพนักงานอยู่ประจำทำการที่กิ่งอำเภอเท่าใด ทั้งนี้แล้วแต่จะสมควรแก่ราชการ แต่ผู้ที่เป็นใหญ่อยู่ประจำทำการที่กิ่งอำเภอต้องอยู่ในบังคับนายอำเภอ และทำการในหน้าที่ในเวลาที่นายอำเภอมิได้มาอยู่ที่กิ่งอำเภอเหมือนเป็นผู้แทนนายอำเภอฉะนั้น
