หมวดที่ ๕ ว่าด้วยลักษณะปกครองอำเภอ

ในเวลาตำแหน่งนายอำเภอว่างก็ดี หรือนายอำเภอจะทำการในหน้าที่ไม่ได้ชั่วคราวก็ดี ถ้าและสมุหเทศาภิบาลหรือผู้ว่าราชการเมืองมิได้มีคำสั่งเป็นอย่างอื่นแล้ว ให้กรมการอำเภอซึ่งมียศสูงกว่าผู้อื่นเป็นผู้แทน
