ในกรณีที่เจ้าหน้าที่ฝ่ายทหารมีเหตุอันควรสงสัยว่า บุคคลใดจะเป็นราชศัตรู หรือได้ฝ่าฝืนต่อบทบัญญัติของพระราชบัญญัตินี้ หรือต่อคำสั่งของเจ้าหน้าที่ฝ่ายทหาร ให้เจ้าหน้าที่ฝ่ายทหารมีอำนาจกักตัวบุคคลนั้นไว้เพื่อการสอบถามหรือตามความจำเป็นของทางราชการทหารได้ แต่ต้องกักไว้ไม่เกินกว่า ๗ วัน
