หมวด ๑ สัญญาหลักประกันทางธุรกิจ

สัญญาหลักประกันทางธุรกิจ คือสัญญาซึ่งคู่สัญญาฝ่ายหนึ่ง เรียกว่า ผู้ให้หลักประกัน ตราทรัพย์สินไว้แก่คู่สัญญาอีกฝ่ายหนึ่ง เรียกว่า ผู้รับหลักประกัน เพื่อเป็นประกันการชำระหนี้ โดยไม่จำเป็นต้องส่งมอบทรัพย์สินนั้นแก่ผู้รับหลักประกัน ผู้ให้หลักประกันอาจตราทรัพย์สินของตนไว้เพื่อประกันการชำระหนี้อันบุคคลอื่นต้องชำระก็ได้
