จำเลยต้องคำพิพากษาให้ปรับแต่ไม่ชำระค่าปรับศาลจึงออกหมายแจ้งโทษให้จำแทนไว้ ระหว่างนั้นปรากฎว่าจำเลยมีทรัพย์พอจะยึดขายเอาเงินใช้ค่าปรับได้ดังนี้ เมื่อโจทก์ร้องขอศาลมีอำนาจสั่งปล่อยจำเลยไปและจัดการยึดทรัพย์ของจำเลยขายทอดตลาดเอาเงินใช้ค่าปรับได้ การฎีกาในข้อกฎหมายนั้นไม่ต้องอ้างตัวบทกฎหมายสนับสนุนก็เป็นฎีกาที่รับไว้พิจารณาได้
