หมวด ๒ วิธีพิจารณาในศาลชั้นต้น

ในชั้นพิจารณา ถ้าจำเลยให้การรับสารภาพตามฟ้อง ศาลจะพิพากษาโดยไม่สืบพยานหลักฐานต่อไปก็ได้ เว้นแต่กรณีมีเหตุอันควรสงสัยว่าจำเลยไม่ได้กระทำความผิดหรือคดีที่มีข้อหาความผิดซึ่งจำเลยรับสารภาพนั้นกฎหมายกำหนดอัตราโทษอย่างต่ำให้จำคุกตลอดชีวิตหรือโทษสถานที่หนักกว่านั้น ศาลต้องฟังพยานหลักฐานโจทก์จนกว่าจะพอใจว่าจำเลยได้กระทำความผิดจริง
