ส่วนที่ ๑ บททั่วไป
(๑) มีสัญชาติไทยหรือมีภูมิลำเนาหรือถิ่นที่อยู่ในราชอาณาจักร
(๒) ไม่เคยต้องคำพิพากษาถึงที่สุดให้จำคุกเนื่องจากกระทำความผิดตามพระราชบัญญัตินี้หรือกฎหมายอื่นที่เกี่ยวข้องกับความผิดทางนิวเคลียร์และรังสี เว้นแต่ได้พ้นโทษมาแล้วห้าปีก่อนวันยื่นคำขอรับใบอนุญาต
(๓) ไม่มีลักษณะต้องห้ามตามมาตรา ๔๖ (๓) (๔) และ (๕)
