หมวด ๓ พนักงานเจ้าหน้าที่

เมื่อได้รับการร้องขอหรือร้องเรียนหรือมีพยานหลักฐานเชื่อว่าเรือประมงที่มิใช่เรือประมงไทยมีสภาพบนเรือที่เป็นอันตรายต่อชีวิต ความปลอดภัย หรือสุขภาพ อย่างร้ายแรง ให้พนักงานเจ้าหน้าที่มีอำนาจขึ้นไปบนเรือและตรวจเรือประมงดังกล่าวที่เข้ามาในราชอาณาจักร และในกรณีจำเป็นอันไม่อาจหลีกเลี่ยงได้จะสั่งให้กักเรือไว้จนกว่าจะมีการแก้ไขกรณีดังกล่าวก็ได้
