ในวาระเริ่มแรก ให้คณะกรรมการสงวนและคุ้มครองสัตว์ป่าประกอบด้วยกรรมการโดยตำแหน่งตามมาตรา ๓๙ ปฏิบัติหน้าที่ตามพระราชบัญญัตินี้ไปพลางก่อนจนกว่าจะได้มีการแต่งตั้งผู้ทรงคุณวุฒิในคณะกรรมการสงวนและคุ้มครองสัตว์ป่าซึ่งต้องไม่เกินหนึ่งร้อยยี่สิบวันนับแต่วันที่พระราชบัญญัตินี้ใช้บังคับ
