(๑) คดีความผิดอันยอมความได้
(๒) คดีความผิดลหุโทษตามมาตรา ๓๙๐ มาตรา ๓๙๑ มาตรา ๓๙๒ มาตรา ๓๙๓ มาตรา ๓๙๔ มาตรา ๓๙๕ และมาตรา ๓๙๗ แห่งประมวลกฎหมายอาญา และความผิดลหุโทษอื่นที่ไม่กระทบต่อส่วนรวมตามที่กำหนดในพระราชกฤษฎีกา
(๓) ความผิดที่มีอัตราโทษจำคุกอย่างสูงไม่เกินสามปีตามบัญชีท้ายพระราชบัญญัตินี้
