ในกรณีมีผู้เสียหายหลายคน ผู้เสียหายซึ่งเข้าร่วมการไกล่เกลี่ยข้อพิพาททางอาญาต้องสมัครใจและประสงค์จะเข้าร่วมการไกล่เกลี่ยข้อพิพาททางอาญา ในกรณีที่มีคู่กรณีมากกว่าสองฝ่าย และคู่กรณีฝ่ายหนึ่งฝ่ายใดไม่สมัครใจเข้าร่วมการไกล่เกลี่ยข้อพิพาท ให้สามารถดำเนินการไกล่เกลี่ยข้อพิพาทระหว่างคู่กรณีที่สมัครใจเข้าร่วมการไกล่เกลี่ยข้อพิพาทได้
