เมื่อพนักงานอัยการมีคำสั่งยุติคดี สิทธินำคดีอาญามาฟ้องเป็นอันระงับ ในกรณีที่มีผู้เสียหายหลายคน หากผู้เสียหายคนหนึ่งคนใดไม่สามารถทำข้อตกลงกับผู้ต้องหาได้ สิทธินำคดีอาญามาฟ้องของผู้เสียหายดังกล่าวย่อมไม่ระงับ
