ในกรณีที่รัฐมนตรี หรือเจ้าหน้าที่ผู้มีอำนาจตามข้อ ๑ เป็นผู้ทำคำสั่งทางปกครองที่กำหนดให้ชำระเงิน ให้รัฐมนตรีหรือเจ้าหน้าที่ แล้วแต่กรณี เป็นผู้มีอำนาจออกคำสั่งใช้มาตรการบังคับทางปกครอง
