ศาลไทยจะไม่พิพากษาให้หย่ากัน เว้นแต่กฎหมายสัญชาติแห่งสามีและภริยาทั้งสองฝ่ายยอมให้หย่าได้ เหตุหย่า ให้เป็นไปตามกฎหมายแห่งถิ่นที่ยื่นฟ้องหย่า
