การกระทำความผิดฐานกระทำทรมานตามมาตรา ๕ และการกระทำความผิดฐานกระทำให้บุคคลสูญหายตามมาตรา ๗ มิให้ถือว่าเป็นความผิดที่มีลักษณะทางการเมืองตามกฎหมายว่าด้วยการส่งผู้ร้ายข้ามแดน และความผิดทางการเมืองตามกฎหมายว่าด้วยความร่วมมือระหว่างประเทศในเรื่องทางอาญา
