พระราชบัญญัตินี้มิให้ใช้บังคับแก่กรณีที่บุคคลได้รับบำเหน็จบำนาญอยู่แล้วตามกฎหมายว่าด้วยบำเหน็จบำนาญข้าราชการฝ่ายพลเรือนหรือกฎหมายว่าด้วยบำเหน็จบำนาญทหาร
