ผู้ขออนุญาตผลิต นำเข้า หรือส่งออกยาเสพติดให้โทษในประเภท ๒ หรือวัตถุออกฤทธิ์ในประเภท ๒ ตามข้อ ๕ (๓) ต้องเป็นหน่วยงานของรัฐที่มีหน้าที่ในการป้องกัน ปราบปราม หรือแก้ไขปัญหายาเสพติด
