ลักษณะ ๕ การเสียสิทธิรับบำนาญ

(๑) กระทำความผิดถึงต้องโทษจำคุก โดยคำพิพากษาโทษจำคุก เว้นแต่ความผิดในลักษณะฐานลหุโทษ หรือความผิดอันได้กระทำโดยประมาท หรือ (๒) เป็นบุคคลล้มละลายทุจริต ตามกฎหมายว่าด้วยล้มละลาย ผู้นั้นหมดสิทธิรับบำนาญปกติ หรือบำนาญตกทอดตั้งแต่วันมีคำพิพากษาถึงที่สุด
