ในกรณีที่มีผู้ขอใบรับรองแบบตามมาตรา ๓๘ และผู้อำนวยการเห็นว่ามาตรฐานที่กำหนดในข้อกำหนดตามมาตรา ๓๔ ไม่ครอบคลุมถึง หรือไม่อาจใช้กับแบบของผู้ขอ เพราะเหตุที่มีวิวัฒนาการหรือลักษณะแผนแบบแตกต่างไปจากอากาศยานหรือส่วนประกอบสำคัญของอากาศยานที่มีใช้อยู่ในขณะนั้น ให้ผู้อำนวยการมีหนังสืออนุญาตตามมาตรา ๓๘ วรรคสาม ไปพลางก่อนเป็นการชั่วคราว พร้อมทั้งกำหนดเงื่อนไขพิเศษเกี่ยวกับมาตรฐานของอากาศยานหรือของส่วนประกอบสำคัญของอากาศยานที่มีวิวัฒนาการหรือที่มีการออกแบบนั้นได้ตามที่เห็นสมควร เงื่อนไขพิเศษที่ผู้อำนวยการกำหนดตามวรรคหนึ่ง ต้องมีระดับความปลอดภัยไม่น้อยกว่าระดับมาตรฐานตามมาตรา ๓๔
