ผู้ที่จะได้รับยศดังกล่าวในมาตรา ๗ จะต้องเป็นผู้ที่มีวิทยฐานะตามที่กระทรวงมหาดไทยกำหนดไว้ เว้นแต่ผู้ที่รัฐมนตรีว่าการกระทรวงมหาดไทยแต่งตั้งเป็นพิเศษ
