ส่วนที่ ๑ ความผิดที่เชลยศึกกระทำ

ห้ามมิให้ศาลพิพากษาลงโทษเชลยศึกโดยไม่ได้ให้โอกาสแก่เชลยศึกในการต่อสู้คดี หรือโดยไม่ให้ได้รับการช่วยเหลือตามเงื่อนไขที่บัญญัติไว้ในข้อ ๑๐๕ แห่งอนุสัญญา
