เมื่อจะต้องจำคุก กักขังหรือขังพระภิกษุรูปใดตามคำพิพากษาหรือคำสั่งของศาล ให้พนักงานเจ้าหน้าที่ผู้มีอำนาจหน้าที่ปฏิบัติการให้เป็นไปตามคำพิพากษาหรือคำสั่งของศาลมีอำนาจดำเนินการให้พระภิกษุรูปนั้นสละสมณเพศเสียได้ และให้รายงานให้ศาลทราบถึงการสละสมณเพศนั้น
