วัดใดเป็นวัดร้างที่ไม่มีพระภิกษุอยู่อาศัย ในระหว่างที่ยังไม่มีการยุบเลิกวัด ให้สำนักงานพระพุทธศาสนาแห่งชาติ*มีหน้าที่ปกครองดูแลรักษาวัดนั้น รวมทั้งที่วัด ที่ธรณีสงฆ์และทรัพย์สินของวัดนั้นด้วย การยกวัดร้างขึ้นเป็นวัดมีพระภิกษุอยู่จำพรรษา ให้เป็นไปตามหลักเกณฑ์และวิธีการที่กำหนดในกฎกระทรวง
