ผู้ใดมิได้รับแต่งตั้งให้เป็นพระอุปัชฌาย์ หรือถูกถอดถอนจากความเป็นพระอุปัชฌาย์ตามมาตรา ๒๓ แล้ว กระทำการบรรพชาอุปสมบทแก่บุคคลอื่น ต้องระวางโทษจำคุกไม่เกินหนึ่งปี
