หมวด ๑ บททั่วไป

ภายในห้าปีนับแต่วันที่ได้รับโฉนดที่ดิน หรือหนังสือรับรองการทำประโยชน์ในที่ดิน ผู้ได้มาซึ่งกรรมสิทธิ์ในที่ดินจะโอนที่ดินนั้นไปยังผู้อื่นไม่ได้ นอกจากการตกทอดโดยทางมรดก หรือโอนไปยังสหกรณ์ที่ตนเป็นสมาชิกอยู่ แล้วแต่กรณี ภายในกำหนดระยะเวลาตามวรรคหนึ่ง ที่ดินนั้นไม่อยู่ในความรับผิดแห่งการบังคับคดี
