ส่วนที่ ๑ การจัดตั้ง

ผู้ใดจะจัดสรรที่ดินในเขตพื้นที่ที่ประกาศเป็นนิคมอุตสาหกรรมตามมาตรา ๓๙ ต้องได้รับอนุญาตเป็นหนังสือจากผู้ว่าการหรือผู้ซึ่งผู้ว่าการมอบหมาย การขออนุญาตและการอนุญาต รวมทั้งการจัดสรรที่ดินที่ได้รับอนุญาตตามวรรคหนึ่ง ให้เป็นไปตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่คณะกรรมการกำหนด
