หมวด ๔ บทกำหนดโทษ

เจ้าพนักงานปกครองท้องที่ผู้ใดออกหมายเกณฑ์ หรือดำเนินการเกณฑ์โดยทางวาจา หรือโดยเครื่องมือสื่อสารซึ่งสิ่งที่เกณฑ์ไม่ได้ตามพระราชบัญญัตินี้ หรือสิ่งที่ทางราชการทหารไม่มีความต้องการ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี หรือปรับตั้งแต่หนึ่งหมื่นบาทถึงหนึ่งแสนบาท หรือทั้งจำทั้งปรับ
