คดีใดที่ได้อุทธรณ์ต่อศาลอุทธรณ์ภาคแล้ว เมื่ออธิบดีผู้พิพากษาศาลอุทธรณ์เห็นสมควร หรือเมื่อคู่ความฝ่ายใดฝ่ายหนึ่งยื่นคำขอโดยทำเป็นคำร้องว่าคดีนั้นไม่สมควรได้รับการพิจารณาต่อไปในศาลอุทธรณ์ภาค ให้อธิบดีผู้พิพากษาศาลอุทธรณ์มีอำนาจสั่งโอนคดีนั้นไปให้ศาลอุทธรณ์พิจารณาพิพากษาได้ คำสั่งของอธิบดีผู้พิพากษาศาลอุทธรณ์ให้เป็นที่สุด
