ส่วนที่ ๑ การขอจดทะเบียนเครื่องหมายการค้า
(๑) เป็นเครื่องหมายการค้าที่มีลักษณะบ่งเฉพาะ
(๒) เป็นเครื่องหมายการค้าที่ไม่มีลักษณะต้องห้ามตามพระราชบัญญัตินี้ และ (๓) ไม่เป็นเครื่องหมายการค้าที่เหมือนหรือคล้ายกับเครื่องหมายการค้าที่บุคคลอื่นได้จดทะเบียนไว้แล้ว
