ในการปฏิบัติหน้าที่ตามพระราชบัญญัตินี้ เจ้าหน้าที่ทหารเรือไม่ต้องรับผิดเป็นส่วนตัวในบรรดาความเสียหายที่เกิดขึ้น เว้นแต่จะได้กระทำโดยจงใจให้เกิดความเสียหาย หรือโดยความประมาทเลินเล่ออย่างร้ายแรง
